A driver is reported as higher than our team level with 5 red stars?

That's intended and no problem, it only means that a soft cap is applied on that drivers training which limits the gain to only 3% per training click. Else you can still use that driver as usual. But there's one thing to keep in mind: You can't hire a driver of a higher level than you, so if you fire such a driver, or let the contract run out, then you won't be able to hire that driver back into your team, at least not until your team gets a level up that is.
