Edit: just seen it. Such a stupid rule. This is so unfair. Imagine driving more out of the car than possible, getting a podium in an underperforming car and then get DSQ'd because you drove all out of the car. So sad?
Yeah but i personally think that Aston Martin appeal will get rejected because of lack of evidence of the car.

It depends I suppose. If the required amount of fuel is indeed in the car and some defect in the fuel pumping system is the cause, one from the race and not mis-constructed, there is a chance as there must be a rule allowing cars to deviate slightly from the rules due to defects, wear due to out of the ordinary circumstamces and accidents, else half the grid would face DSQ every race.
The other chance is the rule itself. A mod collegue made the joke with his ketchup bottle turning it upside down and shaking helps to get remaining ketchup out. If something like that, ie. moving the car, is actually not mentioned as forbidden in the rules Aston Martin could claim they should have been allowed to bring like 5+ techs, or any not forbidden equipment, in to tip the car on one side or lift the front or whatever would've helped to allow the (not working as intended) fuel pickup, well, pick up the fuel. Or what else their legal staff comes up with.
