This driver is without a team for a couple weeks now and listed in my selection, and i check very regular; however there always is a lock over his contract area.
Do you check levels when you shortlist someone? Lvl 12 vs 24. You have to wait a year (racing daily) if you want that driver. You can hire drivers and staff having yellow stars. If the stars are red you can't.

In a thread raising a similar question, the following comment was marked as "Best response."
"Unless you previously owned the driver you can only buy now through the auctions or via your academy. This change was made a few years ago to stop managers using scripts to hoover up all the high level drivers so that other managers couldn’t obtain decent drivers."
