I’m the only player in my league but will incur a penalty if I move to another league, I can understand this prevents league hopping if it were an active league but in this case why am I being penalised?

It's a very small financial penalty (1% of your bank balance) and is there like you say to deter league hopping.
The penalty is a standard one for everyone who plays the game. You can imagine many legitimate reasons that someone would want or need to leave a league, the developers can't be expected to code complex logic into the game ignore the penalty for all of these legitimate reasons.
There may be a work around, I don't know if it will work but it's worth a try. I don't think a penalty is applied if you are kicked. You are the league host... try kicking yourself.
