I found a pilot and he is not under contract with any team. Even though I have enough money and level, the offer section appears to be "locked”. This problem needs to be fixed quickly.

Hello,
In order to stop tech savvy managers using scripts to hoover up all of the good drivers, a change was made so that drivers and staff can only be purchased through transfer auctions.
One exception to this is drivers and staff that have already been a member of your team - these will still be able to be purchased outside of an auction.

Let's assume that the pilot I mentioned was put out to tender. Will I be able to buy that pilot even if it does not appear on my transfer list (via the link)

Hello,
If the driver is put onto the auction house, you should be able to buy them through their link, even if they've never been a part of your team.
However, when free agent drivers go onto auction, is random, so it could be a long time until you're able to buy them.
