The lock symbol you see in the contract tab was introduced to stop the practice of some managers using scripts to find, and buy, available drivers and staff which stopped others being able to buy them.
Unfortunately for you, this means you will be unable to purchase the driver until they go into the in-game auction transfer system, where you will be able to buy the driver.
